1. Acceptance of Terms

By accessing the GuardifyTech Pvt Ltd website or engaging our cybersecurity services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our website or services.

2. Description of Services

GuardifyTech provides professional cybersecurity services, including but not limited to:

• Regulatory Compliance Consulting (RBI, GDPR, PCI DSS, HIPAA, SOC 1 & 2).
• Vulnerability Assessment and Penetration Testing (VAPT).
• Digital Forensics and Cybercrime Incident Response.
• Security Operations Center (SOC) monitoring and Ransomware mitigation.

3. Authorized Use and Legal Compliance

You agree to use our services only for lawful purposes. When engaging us for Penetration Testing, Red Teaming, or any active security assessments, you must provide written, authorized consent proving you own or have explicit legal authority over the targeted networks, systems, or applications. Unauthorized testing or malicious use of our tools is strictly prohibited and constitutes a cybercrime under the Information Technology Act, 2000.

4. Confidentiality and NDA

Both parties agree to maintain the strict confidentiality of all sensitive information exchanged during service delivery. GuardifyTech guarantees that all findings, vulnerabilities, and proprietary business data discovered during audits will be securely handled and communicated only to authorized personnel.

5. Limitation of Liability

While GuardifyTech employs industry-best practices to secure your infrastructure and ensure compliance, cybersecurity is an evolving landscape. We do not guarantee absolute immunity from cyber threats or zero-day attacks. GuardifyTech shall not be liable for indirect, incidental, or consequential damages resulting from cyber incidents occurring outside the scope of our active service agreements.

6. Cybercrime Reporting & Compliance

In accordance with Indian law and CERT-In guidelines, GuardifyTech reserves the right to report severe cyber threats, illegal activities, or breaches of national security discovered during our operations to the appropriate regulatory and law enforcement authorities.

7. Intellectual Property

All methodologies, tools, reports, and documentation provided by GuardifyTech remain our intellectual property. Clients are granted a non-exclusive license to use the delivered reports internally for security enhancement and compliance purposes.

8. Amendments

We reserve the right to modify these Terms of Service at any time. Continued use of our services following any changes constitutes your acceptance of the revised terms.
